Terms of Service

These Terms govern your use of Vivoce, an online platform for conducting and grading oral and written examinations using artificial intelligence ("the Service"). The Service is provided by Vivoce ("Vivoce", "we", "us"). By creating an account or using the Service you agree to these Terms. If you are using the Service for an institution, you confirm you are authorised to accept these Terms on its behalf.

1. The Service

Vivoce lets an examiner author exams, have them delivered adaptively to students (typed or by voice), and have the resulting transcripts graded by a panel of AI models, with results made available to the examiner. Students access exams via a link and do not create accounts.

Examiners sign in with Google. You are responsible for activity under your account and for keeping your sign-in secure. You must provide accurate information and be at least 18 years old (or the age of majority in your jurisdiction).

You are responsible for the exams you create and the data you enter. In particular you represent and warrant that:

4. AI-generated results are an aid, not a final decision. Grades, scores, and feedback produced by Vivoce are generated by automated systems and may contain errors or omissions. They are provided to assist a qualified human assessor. You remain responsible for reviewing results — especially flagged or borderline ones — and for the final assessment decision. Vivoce does not guarantee the accuracy, completeness, or fitness of any AI-generated output and is not a substitute for professional or academic judgment.

You must not: use the Service unlawfully or to infringe others' rights; upload malicious code; attempt to gain unauthorised access to the Service or other users' data; disrupt or overload the Service; or resell or provide the Service to third parties except your own students and staff.

7. Intellectual property

You keep ownership of the exam content and materials you create or upload. You grant Vivoce a licence to host, process, and transmit that content as needed to provide the Service to you (including sharing it with the AI and infrastructure providers described in our Privacy Policy). Vivoce and its underlying software, design, and branding remain our property.

8. Data protection

Our handling of personal information is described in the Privacy Policy. As between you and us, where you enter student information you are the party responsible for that information (its custodian), and we process it on your behalf to provide the Service.

9. Availability

The Service is provided on an "as is" and "as available" basis. We aim for reliable service but do not guarantee it will be uninterrupted or error-free, and we may modify, suspend, or discontinue features.

10. Warranties and liability

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under applicable law that cannot lawfully be excluded. To the maximum extent permitted by law, and subject to those non-excludable rights:

You agree to indemnify Vivoce against claims, losses, and costs arising from your breach of these Terms, your misuse of the Service, or your handling of student or other data without proper authority or consent.

12. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access if you materially breach these Terms or use the Service in a way that risks harm to others or to the Service. Handling of data after termination is described in the Privacy Policy.

13. Changes to these Terms

We may update these Terms from time to time. The "last updated" date reflects the current version; continued use after changes take effect constitutes acceptance.
